Off the Plan Sunset Date Clawback Passed!

On 28 May 2019, the Victorian State Parliament passed the Sale of Land Amendment Bill 2019 (VIC), changing the obligations of a Vendor who seeks to rescind a residential off-the-plan Contract of Sale when a sunset date passes and the plan of subdivision has not yet been registered or, the occupancy permit has not yet issued for the development.

These provisions will apply to sunset clauses in off-the-plan Contracts of Sale retrospectively from 23 August 2018.
